Welcome to Remarcable! By using Remarcable
Services, you agree to these conditions.
Electronic Communications
When you use Remarcable Services, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Intellectual Property
Content covered by intellectual property rights that we have and made available through Remarcable, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of Remarcable Inc. and protected by United States and international copyright laws.You own the intellectual property rights (things like copyright or trademarks) in any such content that you created and shared on Remarcable. Nothing in these Terms takes away the rights you have to your own content. You are free to share your content with anyone else, wherever you want. To provide our services we need you to give us some legal permissions (known as a ‘license’) to use this content. This is solely for the purposes of providing and improving our Products and services. Specifically, when you share, post, or upload content that is covered by intellectual property rights on or in connection with our Products, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, and create derivative works of your content. This means, for example, that if you post or upload product image and information, engineering design drawing on Remarcable, you give us permission to store, copy, and share it with intended people in your organization via our service. This license will end when your content is deleted from our systems. You can delete content individually or all at once by deleting your company account.
License and Access
Subject to your compliance with these Conditions of Use and any Service Terms, and your payment of any applicable fees, Remarcable grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access Remarcable Services. This license does not include any use of data mining, robots, or similar data gathering and extraction tools. No Remarcable Service may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Remarcable. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Remarcable without express written consent. You may not use any meta tags or any other "hidden text" utilizing Remarcable's name or trademarks without the express written consent of Remarcable. You may not misuse the Remarcable Services. You may use the Remarcable Services only as permitted by law. The licenses granted by Remarcable terminate if you do not comply with these Conditions of Use or any Service Terms. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.
Pricing
In the case of a mispriced item by a seller on Remarcable, the seller may contact buyer using Remarcable communication system to reach an agreement. Remarcable will not be responsible for the misplaced item.
Other Businesses
We provide links to the sites of affiliated companies and certain other businesses. We are not responsible for examining or evaluating, and we do not warrant, the offerings of any of these businesses or individuals (including the content of their Web sites). Remarcable does not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.
Sanctions and Export Policy
You may not use any Remarcable Service if you are the subject of U.S. sanctions or of sanctions consistent with U.S. law imposed by the governments of the country where you are using Remarcable Services. You must comply with all U.S. or other export and re-export restrictions that may apply to goods, software (including Remarcable Software), technology, and services.
Warranties
Remarcable is a digital sales platform. Remarcable does not provide any warranty for the any of items sold using Remarcable Service. Warranty is the responsibility of individual manufacturer or distributor.
Limitation of Liability
REMARCABLE SERVICES ARE PROVIDED BY REMARCABLE ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. REMARCABLE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE REMARCABLE SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE REMARCABLE SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE REMARCABLE SERVICES IS AT YOUR SOLE RISK. REMARCABLE DOES NOT WARRANT THAT THE REMARCABLE SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE REMARCABLE SERVICES, REMARCABLE'S SERVERS OR ELECTRONIC COMMUNICATIONS SENT FROM REMARCABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULL EXTENT PERMISSIBLE BY LAW, REMARCABLE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY REMARCABLE SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH ANY REMARCABLE SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.
Disputes
Any dispute or claim relating in any way to your use of any Remarcable Service, or to any products or services sold or distributed by Remarcable or through Remarcable.com will be resolved by binding arbitration.
Applicable Law
By using any Remarcable Service, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Delaware, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Remarcable.
